WV business sued for alleged unpaid invoices

A Kentucky business is taking three West Virginia businesses to court over alleged unpaid invoices.

The suit was filed late last month in Cabell County Circuit Court by Construction Enterprises of the Tri-State Inc and Ross Brothers Construction Company against Huntington Alloys Corporation, Thistle Processing LLC and Caledonian Alloys Inc.

According to the suit, Huntington Alloys, Caledonian and Thistle are joint ventures involved in processing, manufacturing and the selling of metal products at the Huntington plant.

For this reason, the suit asserts businesses are jointly responsible for the alleged debts.

Ross Brothers asserts it entered in a contract with Caledonian in the spring of 2011 to perform work on the businesses' Huntington facilities. 

Ross Brothers asserts Caledonian failed to pay $662,113.28 for work performed.

The suit seeks to enforce a mechanic's lien for unpaid labor and materials provided on the property and the payment for alleged unpaid invoices.

Huntington Alloys, Thistle Processing and Caledonian Alloys have not yet filed a response.
