UBB shareholders trial delayed again

CHARLESTON, West Virginia -

A federal judge has granted another delay in the case brought by former Massey Energy shareholders who say the coal operator lied to them to inflate its stock prices.

The group says Massey wasn't forthcoming about its safety record in the days, weeks and months leading up to the Upper Big Branch disaster in 2010, and that the shareholders didn't find out about Massey's chronic safety problems until the explosion.

Federal prosecutors are withholding information that could help the investors lawsuit, but they say it's a necessary step to protect the criminal probe.

U.S. District Judge Irene Berger issued an order Monday allowing the evidence to remain secret until January 2012, or until the federal government concludes its criminal investigation.
