WV State Police continuing investigation into Wayne County shooting

The West Virginia State Police was called to the scene of a shooting that happened at a gas station on Waverly Road in Huntington.

The shooting happened just before midnight Sunday, when a fight broke out and one man was shot and killed.

Andrew Burgess, 25, of Barboursville, was arrested and charged with first-degree murder in connection with the shooting, troopers said. Burgess killed Thomas Epperly, 40, of Huntington, according to police. Epperly died while being transported to an area hospital.

The victim and suspect did not know each other, troopers said. The victim was shot three times in the chest.  There were several witnesses to the altercation.

Burgess is claiming self-defense, but an investigation continues, according to police.

Burgess is set to appear in a Wayne County courtroom on Monday.
