Charges dropped in Wayne County shooting death - WOWK 13 Charleston, Huntington WV News, Weather, Sports

A Wayne County magistrate has dropped murder charges against Andrew Burgess.

Burgess was charged with murder in the shooting death of Thomas Epperly Saturday night.

The Wayne county Prosecutor's office says the case was dismissed without prejudice which means the case could still be brought before the grand jury if more evidence is presented.

Burgess claimed he shot Epperly in self-defense after a fight at the Rich Oil gas station on Waverly road Saturday night.
