A robbery charge against a former Smithers police officer has been dropped, but he's still facing charges in connection to a home invasion in Fayette County.
West Virginia State Police said Thursday that new information prompted dismissal of the robbery charge against 43-year-old Donald Scott Wills. However, they say charges that more accurately reflect Wills' involvement will be filed.
Police also have arrested 48-year-old Don Naylor and 29-year-old Michael Scarbro, both of Smithers, on robbery and other charges.
The initial report said two men wearing state police jackets and carrying fake badges ordered homeowners to the ground and tied them up as they looked for drugs and cash. Authorities now believe the men did not represent themselves as state troopers, but just identified themselves as law enforcement officers.
