Friday's decision says Raymond and Barbara Hinerman should have been allowed to develop evidence in their lawsuit over the June 2010 purchase.
The Hinermans sued over a water leak in a basement storage room. A circuit judge partly ruled against the couple last year, concluding they were told of the leak before closing on the sale.
The justices found unresolved questions surrounding the water leak issue. Friday's ruling also requires an updating of the property's deed to reflect the purchase agreement between the couples.
