With the 48 hour window for a recount now passed, Charleston attorney J.B. McCuskey is now the official winner of the fourth seat in the 35th district House of Delegates.
The Kanawha County Commission made the announcement in a press release Friday. They finished their vote canvass on Thursday, which saw McCuskey's lead over Del. Barbara Hatfield, D-Kanawha, reduced to 41 votes.
The Commission, which canvasses the vote, cannot certify the vote until 48 hours after the canvassing. That gives candidates time to ask for a recount, which Hatfield did not do.
Hatfield was first elected to the House in 1984 and has served continuously since 1998.
The Commission will set a date and time to certify the vote later.
