A Kanawha County teacher's aide is facing three charges after an incident Monday evening.

Heather Lively, 34, is charged with assault, battery, and possession of a controlled substance.

Lively is a special education aid at Riverside High School in Quincy.

West Virginia State Police said Lively was arrested after they received a call from Metro 911 Communications about a disturbance at Magic Mart.

The manager said Lively took off her cowboy boots and put them on the counter.  Lively said she wanted to return or exchange the boots.  The manager refused, according to court documents.

The manager told troopers Lively started to yell.  She picked up the boots and threw them at the manager's face, troopers said.

Lively was barefoot when troopers arrived on scene, according to the criminal complaint.

Lively was taken to the WVSP Quincy Detachment for processing.

Troopers said they found Suboxone on her.  Lively admitted to buying the prescription drugs from someone on the street, they said.

Lively is current out on bond.
