A $500 fine and up to a year in jail, that's the penalty that 14-year-old Jared Marcum, who was arrested after refusing to change his NRA shirt, could face, now that a judge has allowed the prosecution to move forward with it's obstructing an officer charge against him.
A person was sent to the hospital after possibly drowning in the Elk River, under Spring Street Bridge.
A call was made to 9-1-1 that a person was in the river near 4533 Spring Street in Charleston just after midnight early Thursday morning.
Police say alcohol was involved.
There's no word on the extent of the victim's injuries.
