CHARLESTON, WV (AP) — Another judge has ruled against
West Virginia retirement officials over their handling of pension
credits meant to reward public employees for military service.
Kanawha
Circuit Judge Paul Zakaib has ordered the Consolidated Public
Retirement Board to increase the years of service recorded for five
state employees.
The board has sparred repeatedly with veterans
who go to work for the state over these service credits. Board officials
argue that they apply only for service during armed conflicts. They
cite a roster of conflicts identified in state law.
But Zakaib
agreed with the five veterans that the law does not limit service
credits to those listed conflicts. He called the board's process
unacceptable. But Zakaib stopped short of allowing the case to become a
class-action lawsuit.
