CHARLESTON -

It happened in an instant. 

A child was next to 23-year-old mother Marta Suttles and then it was gone.  Several minutes passed before the Poca resident was reunited with her child at Charleston's Town Center Mall Saturday. 

Police say Suttles was found shopping inside of J.C. Penney's. She was charged with child neglect creating risk of injury. Her child was in the Lee Street parking garage elevator. 

Court records show that Suttles did not call 911 or the malls customer service department. 

Suttles' family, though, said the police got it wrong.

"That is just not true, according to the people that I have talked to," said Robert Suttles, Marta's father. "I think it is a misunderstanding of the worst kind."

The Suttles' allege Marta was not shopping in the department store, but rather working with employees to find her three year old daughter.

Suttles is scheduled to appear in court next week.
