FAIRMONT, WV (AP) — Authorities say no charges will be filed in the rescue of a dog that was swept over waterfalls at Valley Falls State Park.

Park superintendent Ron Fawcett had said he would consult with Marion County prosecutor's office on whether to charge two fishermen who jumped into the Tygart Valley River to rescue the dog.

Swimming and wading are banned at the park.

The prosecutor's office and a state Division Natural Resources spokesman said Tuesday that no charges will be filed.

The incident occurred Saturday when a couple went wading with a little girl and two dogs. One dog jumped off a ledge, was swept over the first set of falls, and became stranded on the rocks.
