Drunk man with 2 DUI convictions re-arrested in Kanawha County

A man with two prior DUI convictions on his record is facing more legal troubles.

Jonathan Byrd, 33, of Saint Albans, was arrested early Wednesday morning.

South Charleston police said they got a 911 phone call from Byrd's girlfriend stating she had been choked by him at an apartment on Colonial Park Drive. The victim said Byrd was drunk at the time of the incident.  He has been arrested for domestic battery against the same woman in the past, police said.

The victim went to the nearby 7-Eleven and called 911.

While at the gas station, police saw Byrd's white truck heading towards Dunbar.  Police stopped him right off of the Dunbar exit and called in Dunbar police to assist.

After running Byrd through the system, police said it showed he had three active DUI's on his record and is not supposed to be driving.  A further look at his criminal history revealed he has been convicted of two DUI's in the past in Kanawha County.  He does not have any pending DUI's in Kanawha County, but could have charges in other counties, authorities said.

Police took Byrd back to SCPD for processing; this is when he started to act belligerent, they said.

Byrd refused to be processed or fingerprinted before being taken to SCRJ.  He also threatened to beat up one of the officers who was handling his arrest, police said.

Byrd has been charged with driving while revoked for DUI, domestic battery, assault on an officer, and failure to submit to booking.

He is being processed at the South Central Regional Jail this morning.
