Macey Stewart, siblings, to remain in foster care; 911 tapes released

A Jackson County magistrate ruled that a girl who vanished last week will remain in the care of the state.

He issued the same order for her three siblings.

Brenda and Frank Stewart appeared in Jackson County Juvenile Court on Monday.

Magistrate Chris Regan decided that Macey Stewart, 6, and her three siblings will remain in foster care. The children were removed from their parent's custody on Friday.

Macey was released from Adena Hospital in Chillicothe, Ohio, on Saturday, according to Jackson Police. She was immediately placed in foster care.

Frank Stewart reported his daughter missing to Jackson Police at approximately 1:30 a.m. Friday.

Before the hearing began Monday, Frank looked at one of his sons across the courtroom. "I'm sorry," Frank silently mouthed.

The children will remain in foster care until another custody hearing on August 22, when attorneys will present evidence to the judge.

Several family members were pleased with Monday's outcome.

"I know my aunt and uncle love her children, but the environment is not good for the children," said Macey's cousin, Jeff Seitz.

Seitz and his mother, Tammy Batey, said their family previously tried to fight for the Stewart children. Seitz claimed that another custody hearing was scheduled for next month before Macey even vanished.

"Right now, it's in God's hands," Batey said. "It should have never come to this."

The Ohio Department of Jobs and Family Services is familiar with the Stewart family, according to a Jackson County Health Department spokesperson.
