HUNTINGTON, WV -

A Huntington, WV man is charged with child neglect after officers found him smoking marijuana while his children were at home.

Robert Scott Fraser, Jr., 24, is charged with felony child neglect creating risk of injury, possession of a controlled substance and obstruction, according to recent court documents.

Deputies with the Cabell County Sheriff's Department say they went to Fraser's home on Hal Greer Boulevard Friday night to talk to Fraser. When they got there, deputies say they knocked on the door several times before it was opened by a 3-year-old. Deputies asked if the toddler's mom or dad was home and he didn't answer. Deputies say they could see another child, a 1-year-old, sleeping in the floor of the home and called out asking if anyone was home. When deputies did not get an answer they say they went into the home and smelled a strong odor of marijuana.

Deputies say Fraser was found in a back bathroom with another person smoking marijuana. When deputies tried to search Fraser, they say he pulled away and that's when he was taken into custody.
