The lawyer of a teenager facing murder, kidnapping, and conspiracy charges in the death of Skylar Neese has filed a motion to dismiss the testimony of her alleged co-conspirator Rachel Shoaf.

Shelia Eddy's lawyer challenges the mental stability and stress Shoaf was under when she pleaded guilty and named Eddy as a co-conspirator.

In January Shoaf told investigators she and Eddy, now 18, took Neese to Pennsylvania, killed her, and tried to bury her body. Shoaf pleaded guilty to second degree murder in May and faces up to 40 years in prison.

The dismissal motion was one of a dozen filed Monday by Eddy's lawyer Michael Benninger.

Benninger also asked the court to relocate the trial and use outside jurors, stating that "the defendant asserts that she cannot obtain a fair and impartial trial in Monongalia County due to the existence of substantial publicity and prejudice existing against the defendant."

The defense also filed a motion to continue, which would delay the trial past October 22, which is currently the scheduled date for her trial, and asked the court to set bail. Eddy is currently being held in a juvenile facility without bail.

On September 17, Eddy pleaded not guilty to murder, conspiracy, and kidnapping charges.

A motion status hearing will be held October 15.
