Innocent driver killed during police chase in Lawrence County, KY

Kentucky State Police tried to pull over the driver of a fast moving vehicle about 6:30 Friday night.   Instead of stopping, the driver instead took off.  The high speed chase took state police through a school zone near the Lawrence County High School stadium where the team was about to take on Shelden Clark.

The driver of a Toyota Camry then crossed the center line just past the high school and hit the driver of an on coming motorcycle driven by 40-year-old Johnny Maynard of Catlettsburg, KY.

Maynard was taken to an area hospital where he died.

The driver of the Camry was identified as 34-year-old Joshua Fitzpatrick of Paintsville, KY.  He was charged with murder, fleeing and evading police 1st degree, operating motor vehicle under the influence, driving on a suspended operators license.  It was later discovered Fitzpatrick was involved in a domestic dispute and was not authorized to drive the Camry.

A fifth-grader who videotaped the crash scene by her home on B Street, just outside of Louisa, says she wishes police would have backed off in their pursuit of Joshua Fitzpatrick.

"I don't think the cops should have been chasing him," says Shaleigh Boyd, age 11. "It's a very busy road."

Considering the time, place, and the crowd arriving for the football game, neighbors near the crash scene raised questions about the state police agency's policy on chases through neighborhoods.

13 News reached out to Kentucky State Police several times, to learn more about their policy, however the messages were not returned.

The Kentucky State Police arrested one person after a high speed pursuit along US 23 and KY 644 near Louisa

 

According to police the Kentucky State police received a report of a 2001 Toyota Camry was seen traveling northbound along US 23 in a reckless manner just before 6:30 PM Friday.

The vehicle was located the vehicle accelerated when police initiated his emergency lights and attempted to pull the vehicle over.

The vehicle later lost control near the intersection of KY 644 and B St and into the path of a motorcycle operated by Johnny Maynard Jr. of Catlettsburg, KY. Maynard was thrown from the motorcycle.

Maynard was transported to Three Rivers Medical Center where he was later pronounced dead by Lawrence County Corner.

Troopers arrested and charged Joshua A. Fitzpatrick of Paintsville, KY with murder, fleeing and evading police 1st degree, operating motor vehicle under the influence, driving on a suspended operators license.

Police also say, Fitzpatrick was also believed to had been engaged in a domestic dispute in Paintsville earlier in the day and had fled the scene and was seen flee in a stolen tan 2001 Toyota Camry.
