UPDATE:

A home invasion suspect who was shot when he tried to break into a Logan County, WV home is out of the hospital and under arrest according to the West Virginia State Police (WVSP).

Jimmy Walker, 35, was charged with burglary and conspiracy according troopers with WVSP.

The investigation is still continuing at this time.

Troopers with the West Virginia State Police are investigating a home invasion in which a suspect was shot, and another was arrested in Logan County, WV.

Troopers said it happened just after 5 a.m. Saturday, Dec. 21 at a home in the area of Harmony Lane in Christian, roughly five miles north of the Mingo County line.

According to troopers, two male suspects, Jimmy Walker and Justin Allen Blair, broke into the home.

The home owners were out of town. Troopers said Terry Robbins, a family member who lives down the street, was contacted by the homeowner to investigate. He then went over, armed with a handgun, to investigate. According to troopers,  Robbins spotted Walker and Blair, told them to put their hands in the air, and Robbins shot Walker.

"I gave him several warnings to hit the ground and not to move, or anything like that," says Robbins. "He didn't heed it, and it was two to one, so I had to do what I had to do to protect myself."

Troopers said Robbins held both Walker and Blair at gunpoint until State Troopers arrived.

Walker was taken to an area hospital and is in critical condition.

Troopers said Blair was arrested and put into a cruiser, but kicked the rear window out and ran into the woods.

Troopers received a tip that Blair was hiding at a nearby home, and arrested him around 12 p.m.

According to troopers, the shooting is considered justified and no charges are expected to be filed against Robbins.
