Police arrested a male for sexual assault in St. Albans, WV.

According to a news release issued by the St. Albans Police Department, Tristan W. Pennington, was arrested Friday night of Feb. 14 on the charge of 3rd degree sexual assault.

The news release says police spotted a truck parked on the lot of the former Belvil Elementary School, located in the 2000 block of Washington Avenue at around 8:39 p.m. Friday.  When police went to the truck, they saw Pennington involved in what appeared to be a sexual act with a girl who appeared quite young.

Police asked the girl how old she was, in which she said she was 12-years-old.  They confirmed her age by contacting her mother.

The news release says Pennington was taken to the St. Albans Police Department for processing.  It goes on to say that the girl's mother agreed to have her daughter give a statement confirming the act, in which police found out that texts had been exchanged between both the girl and Pennington, where he asked to have sex with her on Valentine's Day. Police say the mother also agreed to have her daughter's cell phone examined.

According to the news release, Pennington gave a statement confirming the incident saying he picked the girl up several blocks away from her home, as her parents would not have approved of this, and Pennington also voluntarily surrendered his cell phone to police for forensic examination.

Pennington was arraigned Saturday morning and was released on bail, and is facing a penalty of one to five years in prison and/or a $10,000 fine.  Police say that sex offender registration would be mandated as well.
