Man arrested for murder in Wayne County, WV

A preliminary hearing was held for Brien Scott Bays at the Wayne County Magistrate Court Wednesday, April 2.

Probable cause was found, and the case is being handed over to a grand jury, which will be held in July.

Bays is still being held without bond in the Western Regional Jail.



A man is in jail for a murder in Wayne County, WV.

According to Sgt. S.G. Poff, Detective with the Wayne County Sheriff's Office, Brien Scott Bays, 42, was charged with murder.

Sgt. Poff told 13 News that he received a call about a shooting in the area of River Bend Road in Crum at 12:45 a.m. Saturday, March 29.

While Sgt. Poff was en route to the scene, he was told the victim, Richard Laney, was struggling to breathe, and when Sgt. Poff arrived at the scene, he found Laney dead in the doorway of his residence, with two gunshot wounds to his right chest and abdomen.

According to a witness, Bays was at the witness' residence, highly intoxicated, waving a Taurus Judge Revolver pistol around, trying to get people to drink with him.  When the witness told Bays to leave, Bays went to start up his ATV, and at some point during this, the witness heard gunshots.

Sgt. Poff said that when the witness went to check it out, he saw Laney lying in the doorway of his residence.  When the witness tried to revive Laney, the only thing Laney told him was to get his wife, who had been asleep when this happened.  The witness told Sgt. Poff that Bays fled the scene on his ATV.

After search and arrest warrants were obtained, a manhunt ensued on Bays, in which he was apprehended at 11:45 a.m. Saturday by the WV State Police SRT Team (Special Response Team), along with Wayne County Sheriff's Deputies, and U.S. Marshal's.

Once Bays was apprehended, he cooperated with police by taking them to where he had hidden the murder weapon, which was recovered by way of a search warrant at an outbuilding belonging to a friend of Bays.

Bays is being held in the Western Regional Jail.

According to Wayne County 911 dispatchers, a call came in of a shooting in the area of River Bend Road in Crum at 12:50 a.m. Saturday, March 29.

Dispatchers tell 13 News that the victim died from his wounds.

The name of the suspect is not yet known.

The Wayne County Sheriff's Office is investigating.
