UPDATE:

An order was handed down Thursday, April 24, by Judge Duke Bloom on the special prosecutors who were appointed after Kanawha County Prosecuting Attorney Mark Plants was disqualified from all cases involving crimes of violence by a parent, guardian or custodian against a child, abuse or neglect cases under WV Code Chapter 49 and criminal violations of domestic violence protection orders.

Donald P. Morris was appointed as Chief Special Prosecutor, while Rocky Holmes, Amy Bird, and Adam Petry were appointed as Assistant Special Prosecutors.

A judge has ordered that Kanawha County Prosecuting Attorney Mark Plants be disqualified from all cases involving crimes of violence by a parent, guardian or custodian against a child, abuse or neglect cases under WV Code Chapter 49 and criminal violations of domestic violence protection orders.

The judge said he will order the appointment of special prosecutors in a separate order.

Kanawha County Prosecuting Attorney Mark Plants was back in court today.

A Kanawha County Circuit Judge heard arguments on whether Plants and his office should be disqualified from handling domestic violence cases involving children.

Kanawha County Circuit Judge Duke Bloom did not make a ruling on whether Plants and his entire office, a total of 22 people, should be disqualified from handling such cases brought by Charleston police.

He did, however, ask the prosecutor's office to file a list by 4 p.m. Tuesday of all cases where there could be a potential conflict of interest. The list includes all violations of protective order cases, all domestic violence cases involving a parent, guardian or custodian and all felony cases involving a parent, guardian or custodian.

The prosecutor's office said this list could include hundreds of cases.

Both the city of Charleston and the Kanawha County Prosecutor's Office want guidance from the court on how they should be handling domestic violence cases.

Plants faces two misdemeanor charges.
