A man is back in custody after inadvertently being released from the Boyd County Detention Center.

James Brewer was released around 5:15 a.m. Tuesday from the Boyd County Detention Center. Brewer was in custody for fraudlent use of a credit card, giving false information to an officer, resisting arrest, and 3rd degree assault on an officer.

Brewer assumed the identity of Todd Lesniak, who was also in the center and was scheduled to be correctly released Tuesday.

Brewer was able to identify himself as Lesniak and was released. The error was discovered a few minutes later by jail personnel, and law enforcement was alerted.

Brewer was found walking on the 4500 block of Winchester Avenue, and after a foot pursuit, evaded capture. However, he was found under the crawl space of a residence around 8:45 a.m. and was taken into custody.

Jail personnel along with Catlettsburg PD, Boyd County Sheriff, and the Ashland Police Department immediately responded to the scene.

Brewer was charged with Escaped 2nd degree.
